Courthouse News for December 25th, 2019

On December 14th, Buchanan County Prosecutor Chad Gaddie filed charges against Galen Deatherage (60) of St. Joseph alleging Assault (Felony). Bond was set at $10,000, cash only and no contact with victim. KQ2 reported that it was in conjunction with the hit and run accident in which Deatherage was allegedly dropping off a passenger, drove his car towards a pedestrian walking in front of the building, struck him, and then struck a handicapped parking sign.

On December 15th, Ringgold County deputies were dispatched to an accident on Highway 25 in which a vehicle driven by Benjamin Peterson (23) of Minnesota lost control of his vehicle and struck the cable barriers on the east side of the roadway. There were no injuries.

On December 15th, Ringgold County deputies were dispatched to a vehicle on P27 that had gone off the roadway and rolled at around 10:29 pm. Neil Baggesen (34) of California was traveling northbound when he lost control of his vehicle and overturned it onto the passenger side. There were no injuries.

On December 16th, a Maryville resident nearly became the victim of a scam, according to the Maryville Forum. The woman had been contacted by a person posing as a federal agent, telling them that they would be arrested if they did not withdraw tens of thousands of dollars from their bank and overnight it to an address in another state. The woman withdrew the funds and shipped the money; however, she confided in a family member. The family successfully had the shipment stopped and returned. Subsequently, the scammer contacted the victim again and threatened her; he then contacted Maryville Public Safety pretending to be law enforcement and reporting that there were drugs in the package. The scammer also contacted the Maryville Forum from a spoofed FBI number promising a big scoop regarding drugs. The FBI says that if anyone is contacted by someone purporting to be from the FBI to verify the information with the bureau. Their St. Louis number is (314) 589-2500, and other field offices are listed at www.fbi.gov.

On December 17th, Buchanan County Assistant Prosecutor Kristina Zeit filed charges against Bryan Atkins (20) of Rosendale alleging Unlawful Use of a Weapon (Exhibiting, Felony). Bond was set at $7,500, cash only; defendant is to have no contact with the victim or be on the property of 3123 North Belt Highway. KQ2 reported that according to the Probable Cause statement, Atkins allegedly walked into Vapor Maven, grabbed a female employee, and told her to take her clothes off. The employee told him there were security cameras present, and he left.

On December 17th, Harrison County Prosecutor Jonathan Meyer filed charges against Coltyn Clark (25) of New Hampton alleging Hunting from a Public Roadway and Hunting from a Vehicle.

On December 17th, Harrison County Prosecutor Jonathan Meyer filed charges against Jacob King (27) of Ridgeway alleging No Valid Permit.

On December 17th, Harrison County Prosecutor Jonathan Meyer filed charges against Cody Clark (19) of New Hampton alleging Hunting from a Vehicle.

On December 17th, Gentry County Prosecutor Jessica Jones filed charges against Dustin Stone (22) of Grant City alleging No Insurance.

On December 17th, Nodaway County Prosecutor Robert Rice filed charges against Alex Chapman (20) of Oskaloosa (IA) alleging Property Damage.

On December 18th, Nodaway County Prosecutor Robert Rice filed charges against Zacher Sapp (18) of Maryville alleging DWI.

On December 18th, the Nodaway County Sheriff’s Office recovered a long gun on the east side of Nodaway County. The owner subsequently came and claimed the gun and presented proof of ownership.

On December 18th, a vehicle driven by Paul Brand (88) of Mount Ayr pulled from the stop sign at Taylor Street in Mount Ayr into Columbus and didn’t see a vehicle driven by Darla Howell (50) of Blockton. Minor damage was sustained to both Brand’s and Howell’s vehicles. There were no injuries at the time of the accident.

On December 18th, Harrison County Prosecutor Jonathan Meyer filed charges against Darrell Palmer (27) of McFall alleging Possession of Controlled Substance (Felony).

On December 18th, Worth County Prosecutor Janet Wake Larison filed charges against Mauricio Castaneda (20) of Lenox alleging No Insurance.

On December 18th, Worth County Prosecutor Janet Wake Larison filed charges against James Burton (33) of Darlington alleging Failure to Register.

On December 18th, Worth County Prosecutor Janet Wake Larison filed charges against Wade Rush (21) of Parnell alleging Speeding.

On December 19th, Northwest Mo Info reported that family members of the Diemel brothers filed a wrongful death lawsuit in Caldwell County related to the deaths of Nichols and Justin Diemel near Braymer. Named as defendants were accused murderer Garland Nelson, mother Tommie Feil, and J4S Farm Enterprises, the farm company that employed Nelson. The lawsuit alleges that the defendants failed to exercise reasonable care to supervise the activities of Nelson despite the fact that he had been convicted in 2016 of Cattle and Insurance Fraud and had served 17 months in prison. Furthermore, the suit alleges that the defendants did not disclose the information to the Diemel brothers when agreeing to care for their cattle. The suit seeks monetary damages for loss of future wages, funeral expenses, and pain and suffering.

KQ2 reports that a robbery suspect who had robbed a Moberly gas station, Shawn McCormick (26), was charged with Robbery (Felony) and Armed Criminal Action (Felony) after he had disguised himself by wearing underwear on his face.

On December 19th, CNN reported that a 17 year old girl climbed a fence, stole a plane, and crashed it into a fence at Fresno (CA) Yosemite International Airport on the 18th, damaging the plane.

On December 20th, Secretary of State Jay Ashcroft’s Securities Division ordered unregistered agents Daniel Madasz Sr., Henrik Jensen, Patrick Kucera, Kenneth Marg, John Myers, and their companies to cease and desist after soliciting $347,500 in unregistered securities. Ashcroft’s office alleged that in 2016, Madasz provided investment advice to a Missouri resident and convinced them to invest $200,000 with Skytec Security Operations, which were operated by Jensen and Kucera. Madasz promised a 12% return on investment, which did not occur. They were not registered to give investment advice or sell securities.

In March 2016, Madasz convinced two Kansas residents to invest $147,500 in return for promissory notes by promising a minimum of 1% per month on investments. He subsequently invested it in a high-risk foreign currency trading program; after significant losses, he then invested what was left with Skytec Roofing LLC, owned by Marg and Myers, neither of whom are registered to offer or sell securities. Ashcroft’s office ordered the agents and their companies to show cause why they should not be ordered to pay restitution, interest, civil penalties, and investigation costs totaling more than $1.34 million.

On January 20th, Secretary of State Jay Ashcroft’s office ordered Stoney Davin Shaw and his company, Surgioscopy LLC, to repay $2.6 million plus 8% interest. Ashcroft’s office says Shaw, an unregistered agent, solicited 47 investors from four states to invest more than $2.6 million in unregistered, non-exempt securities. He falsely promised investors 12% interest every 90 days, paid minimal returns, and used funds for personal expenses, comingled funds with another account, and made numerous cash withdrawals.

On December 20th, the Missouri State Highway Patrol arrested Steven Richardson (22) of Hopkins in Nodaway County on a Buchanan County Warrant (No Seat Belt) and three Maryville Warrants (Minor Visibly Intoxicated, Failure to Register, No Insurance).

On December 20th, the Missouri State Highway Patrol arrested Kelly Mothershead (63) of Lees Summit in Nodaway County on charges of DWI and Failure to Drive on Right Half.

On December 20th, the Missouri State Highway Patrol arrested Dawn Adams (39) of Gilman City in Harrison County on charges of Failure to Appear (No Seat Belt), Driving While Suspended, and No Seat Belt.

The St. Joseph News-Press reported that on December 20th, a Buchanan County jury convicted Angela Mason of Voluntary Manslaughter and Armed Criminal Action for the death of her husband. The jury sentenced her to 23 years.

On December 20th, the Nodaway County Sheriff’s Department posted the following news release regarding a rash of mailbox vandalism that took place around the county in November.

On November 5, persons unknown traveled down 240th Street intentionally damaging mailboxes. This was reported again on November 12th, this time on Katydid Road. Deputy Cory McDonald took the reports and he has been diligent in his efforts to identify those responsible. After following leads and conducting interviews of persons of interest, Deputy McDonald has identified those responsible and he has obtained admissions of involvement. Two 17-year-old males were involved as well as several 16-year-old juveniles. A complaint will be forwarded to the Prosecuting Attorney for those age 17. The remaining will be referred to the Juvenile Office. Deputy McDonald will be contacting the property owners. 

On December 20th, Harrison County Prosecutor Jonathan Meyer filed charges against Charles Miller (53) of Bethany alleging Child Molestation (Felony). Bond was set at $25,000, cash only.

On December 21st, the Missouri State Highway Patrol arrested Homero Medrano (43) of Mission (TX) in Harrison County on a charge of DWI.

Charges listed are mere allegations. Evidence in support of the charges must be presented before a court of competent jurisdiction whose duty it is to determine guilt or innocence. All defendants are presumed innocent until proven guilty.
