Courthouse News for November 13th, 2019

On August 6th, Livingston County Adam Warren filed charges against Todd Grigsby (32) alleging Unlawful Use of a Weapon (Felony), Resisting Arrest (Felony), and Possession of Controlled Substance (Felony). The defendant was released on his own recognizance with the following conditions – defendant was placed in the custody of his mother, and cannot leave her home except for mental health visits and check-ins with Supervision Services. He had allegedly stood armed outside a residence in Chula (MO) and had fled with law enforcement arrived.

Garland Nelson, the person facing murder charges in Braymer following the death of two brothers, faces additional charges in Kansas. He faces charges in Bourbon County (KS) alleging Endangering the Food Supply. Nelson allegedly transported 35 calves from his farm to a farm on Fort Scott (KS) without health papers. The 35 calves were sick. Another farmer bought 96 calves, but 61 of them were sick.

A ten year old involved in the death of 14 year old Cameron Satterley (14) of St. Joseph was committed to the Missouri Department of Youth Services. Statterley had been reported missing and was found in a burned house in April in St. Joseph. The ten year old was committed for Involuntary Manslaughter (Felony) and Arson (Felony). A 12 year old faces related charges.

On November 3rd, a semi truck driven by John Larson (70) of Mount Ayr was northbound on Route P64 in Ringgold County at around 6:40 pm when it struck a steer owned by Harold McChesney (85) of Hatfield. There were no injuries.

On November 4th, Randy Constant of Chillicothe was found dead at his home from an apparent suicide by carbon monoxide poisoning. The Friday before, he had been sentenced in Cedar Rapids (IA) Federal Court to 122 months on charges involving a $142 billion grain fraud scheme. He had allegedly misled customers into thinking they were buying certified organic grain when it was not organic.

On November 4th, James Larue escaped from custody following a court hearing on charges of Assault (Felony) and Armed Criminal Action (Felony) in DeKalb County. He was subsequently recaptured and faces an additional charge of Escape from Custody. Bond was set at $50,000 cash only with the following special conditions – report regularly, seek employment or commence an education program, not possess a firearm, and not possess alcohol or a controlled substance without a valid prescription.

On November 4th, Judge Roger Prokes sentenced Austin Reed (25) of Maryville to six years in the Missouri Department of Corrections on a charge of Possession of Child Pornography (Felony). Court retains jurisdiction for 120 days and can recall him to serve parole or probation. Reed had pleaded guilty in October. He must register as a Sex Offender for 15 years, although it can be reduced to 10 years if good conduct measures are met.

On November 5th, Jonathan Smith (22) stole a truck from Fillmore (MO) and led police on a two county chase that ended when he crashed over an embankment. On November 6th, Andrew County Assistant Prosecutor Steven Stevenson filed charges against Smith alleging Stealing (Felony), Tampering with a Motor Vehicle (Felony), two counts Resisting Arrest (Felony), Assault (Felony), Possession of Controlled Substance (Felony), and Property Damage (Felony). Bond was set at $20,000 with $10,000 to be cash only. Defendant must submit to total house arrest with drug tests two times per week.

On November 6th, Nodaway County Prosecutor Robert Rice filed charges against Kylan Harrell (22) of Maryville alleging Driving While Revoked and No Head Lamps.

On November 7th, Nodaway County Prosecutor Robert Rice filed charges against Stephanie Morriss (31) of Maryville alleging Possession of Controlled Substance (Felony). Bond was set at $10,000 with defendant given leave to post 10% cash.

On November 7th, Nodaway County Prosecutor Robert Rice filed charges against Roland McManis (54) of Maryville alleging Assault.

On November 7th, Nodaway County Prosecutor Robert Rice filed charges against Hayden Sidwell (19) of Country Club Village (MO), Layne Anderson (18) of Helena (MO), and Jace Prater (18) of Maryville alleging Minor in Possession.

On November 7th, a St. Joseph Police patrol car was struck by a stolen vehicle at around 2:37 am. No injuries were reported, and the suspect was not in custody as of Thursday afternoon.

On November 7th, Secretary of State Jay Ashcroft’s Securities Division issued a consent order against Kirk Urick, of Blue Springs, Missouri, after he misled seven Missouri investors in the sale of $69,150 in unregistered securities. Beginning in 2006, Urick began soliciting money from individuals to patent and market an automotive device. Urick attracted seven investors from Blue Springs, Lee’s Summit and Kansas City, Missouri, to invest $69,150 in an unregistered profit sharing agreement.

Urick didn’t pay a return on the investments and hasn’t returned the original investments despite demands by investors. Urick strung the investors along for several years by making false statements about the success of the automotive device and false promises that payments would be made. The division ordered Urick to offer investors rescission of the investment and pay investors $69,150 plus 8 percent interest from the date of the original investment. The order also requires Urick to pay $10,000 in penalties and $5,000 to the investor education fund, but suspends these payments if investors are repaid in a timely manner.

On November 7th, the Missouri State Highway Patrol arrested David Smith (25) of Milwaukee (WI) in Harrison County on charges of No Valid License, Speeding, and No Seat Belt.

On November 7th, Harrison County Prosecutor Jonathan Meyer filed charges against Sean Court (37) of Ridgeway alleging Driving While Revoked.

On November 7th, Harrison County Prosecutor Jonathan Meyer filed charges against Ala Mohamad Rashed (28) of San Antonio (TX) alleging No Valid Interstate Fuel License.

On November 8th, Harrison County Prosecutor Jonathan Meyer filed charges against Marvin Yarrington (59) of Bethany alleging Sexual Misconduct Involving Child Under 15 (Felony). Bond was set at $5,000, cash only.

On November 8th, Nodaway County Prosecutor Robert Rice filed charges against Samuel Paulson (25) of Maryville alleging Counterfeiting.

On November 8th, Nodaway County Prosecutor Robert Rice filed charges against Ryan Grady (28) of Maryville alleging Domestic Assault and Tampering With a Victim.

On November 8th, Judge Patrick Robb sentenced Sydney Jones (29) of St. Joseph to Life Imprisonment for Abuse & Neglect of a Child Resulting in Death. She was sentenced in conjunction with the drowning death of her six month old son on December 7th, 2017. On July 24th, she was convicted following a jury trial. The defense had argued that the defendant had paranoid schizophrenia which should have been considered in the sentencing.

On November 9th, the Ringgold County Sheriff’s Department arrested Nathan Ford (36) in Diagonal on a Clarke County Warrant (Probation Violation).

KMA reports that on November 9th, a dead body was located one mile north of Clarinda in a field. The body has been sent in for an autopsy. If you have any information about what happened, contact the Page County Sheriff’s Department at (712) 542-5193.

On November 9th, the Missouri State Highway Patrol arrested Jackie Myers (55) of Bethany in Harrison County on a charge of DWI.

The Nodaway County Sheriff’s Department issued the following release regarding a home invasion that happened in Nodaway County Sunday morning:

On Sunday, November 10, 2019, at about 7:50 AM, law enforcement was notified of a home invasion by an armed suspect. The victims were husband and wife, ages 87 and 85. Their home is located in the 27000 block of Glacier Road in rural Maryville. Due to the seriousness of the crime and the size of the crime scene, Sheriff Strong requested assistance of detectives from Maryville Police and on duty members of the Missouri State Highway Patrol. 

The victims report that around 5:00 AM, the suspect gained entry into their home and confronted them in their bedroom after waking them from their sleep. The suspect was armed with a knife that he brandished while threatening the two victims.

The suspect was also carrying an axe. The suspect confined the two victims in their bedroom and took both of their cellular phones. 

 During this crime, the suspect took cash, a silver tea set, a television, the woman’s purse and contents, and other items from the home. The suspect set fire to newspapers in the kitchen before leaving around 7:30 AM. The fire did not spread. The suspect left the home after stealing the victim’s 2006 Lincoln Super Crew pickup truck. The crime scene involved the interior and exterior of the home as well as a machine shed on the property. 

It appears that the suspect may have attempted to set a fire in the shed. A brown leather coat was found at the scene at the rear of the home beside a window screen that had been removed from the window. The coat did not belong to the victims. The victims gave a description of the white male, including some behavior that led investigators to believed that the suspect was under the influence of drugs. The suspect covered part of his face with a tee shirt. The victims were unable to call since their phones were stolen. They used another vehicle to drive to a relatives’ home in Maryville for help.

The victim’s cellular phones were located by Troopers on 270th between Hawk and Hallmark Road. One phone had been used by the suspect and valuable evidence on the phone provided a person of interest. The person of interest fit the physical description provided by the victims.

During the subsequent investigation, it was learned that the person of interest was most likely staying in St. Joseph, MO. The brown leather coat found at the scene was positively identified as belonging to the person of interest by a witness.

Contacts were made with the St. Joseph Police Street Crimes Unit, Police Officers, and the Buchanan County Drug Strike force. Detective Cochenour of Nodaway County and Detectives Glidden and James from Maryville PD traveled to St. Joseph. At about 8:20 PM the suspect was located in an apartment that contained property reported stolen during this incident. He was questioned and he is currently being held in the Buchanan County Jail. The truck was recovered in St. Joseph.

Nodaway County Prosecutor Robert Rice charged Trevin James Wilmes, age 23, with Burglary 1st Degree, Armed Criminal Action, Kidnapping 2nd Degree, Felony Stealing, and Felony Tampering with a Motor Vehicle 1st Degree. He has not been given a bond.

Wilmes was charged in Nodaway County on 07/01/2018 with 5 counts of burglary 2nd degree, fraudulent use of a credit device, 1st degree property damage, felony stealing 2 counts, and 2 counts of tampering with a motor vehicle in the 1st degree. On 09/24/2018 he entered a guilty plea to the charges. He was sentenced to 4 years to be served in the Department of Corrections beginning on 12/17/2018. Records show that he was released from prison and placed on parole on 09/03/2019.

I wish to thank St. Joseph Police Chief Connally, Buchanan County Sheriff Bill Puett and Maryville Police Director Wood who provided officers and deputies to assist. And thank you to the members of the Missouri State Highway Patrol that assisted us. I am very proud of the detectives that worked all day on their day off giving this case due diligence. And Major Houston that worked the crime scene. They are true professionals that I am happy to call friends. From beginning to end they cleared this case in about 15 hours and took the suspect off the street before he could victimize others. They are busy today writing reports.

Sheriff Strong

On November 10th, the Ringgold County Sheriff’s Department arrested Jeffrey Shields (37) of Diagonal on charges of Domestic Assault. He is being held on no bond until seen by a magistrate.

On November 11th, the Missouri State Highway Patrol arrested Kenneth Breit (44) of Norman (OK) in Nodaway County on a Taney County Warrant for Failure to Appear (Larceny).

On November 11, 2019, the Taylor County Sheriff's Office received a call from the Taylor County Secondary Roads Crew that they found a vehicle in the ditch in the 2200 block of Highway 148, with a subject inside.

Upon arrival it was evident that the vehicle slid off the road due to snowy conditions. An investigation led to suspicion that the driver was under the influence of alcohol and the driver was taken into custody for further testing. As a result of the tests given, Brian LaRose, 55, of Gravity, was charged with Operating a Motor Vehicle Under the Influence of Alcohol 3rd or Subsequent Offense. LaRose is being held at the Taylor County Jail on $5,000 bond pending an initial appearance with the Magistrate.

LaRose was previously arrested on November 8, 2019 at his residence for failure to appear for court. He was originally charged with leaving the scene of a property damage accident. He was seen by a Magistrate and was released on that charge.

Charges listed are mere allegations. Evidence in support of the charges must be presented before a court of competent jurisdiction whose duty it is to determine guilt or innocence. All defendants are presumed innocent until proven guilty.
